The largest risk of noncompliance for merchants is the increased risk of susceptibility to a data breach. The average cost to recuperate from a data breach is $215 per compromised card number. Worse, 70% of small- to medium-sized businesses never recover from a data breach.

There can be large fines involved in a breach too. PCI Compliance doesn’t entirely neutralize this threat. It does educate a merchant on industry best practices, showing them the active steps to take for the best breach prevention. If a merchant is found to be in noncompliance, costly fees could be levied against them.

PCI DSS stands for Payment Card Industry Data Security Standard. This set of requirements concerns how a merchant or entity processes credit cards. The PCI Security Standards Council developed PCI in 2006. This council consists of five major card brands: Visa, MasterCard, American Express, Discover, and JCB.

PCI DSS has different compliance requirements for different levels of merchant processing transactions.

  • Level 1: >6 million annual card transactions
  • Level 2: 1 to 6 million annual card transactions
  • Level 3:  20K to 1 million annual transactions
  • Level 4:  <20K annual transactions

You may also be required to have an elevated level of compliance if you’ve had a data breach or if your payment processing structure could pose an information risk.

There are 12 PCI DSS requirements for your business to be compliant as you process credit card payments. Just a few of those include:

If, as a merchant, you plan to be a credit card processor, you must know your necessary PCI DSS level and the specific compliance standards for operations. When you “batch out” your day’s credit cards, the process compiles your customer’s payment information and authorization. It creates a file for each transaction that gets stored until it’s sent, along with those authorization codes, to the bank.

Most of the time, this process takes about 48 hours to complete as the credit card company and the acquiring bank communicate, putting the transaction data through fraud analysis before eventually processing the the payment. Basys accelerates this process so that you receive next day funding for credit card processing.

For maximum safety, Clover doesn’t store your card information, instead creating a secure digital token. Whenever you request a deposit, they email you an identification code to verify your identity. Only people who have employee app owner permissions can request a Clover Rapid Deposit and get next day funding for credit card processing.

Surcharging first became legal as the result of a claim brought by U.S. merchants against Visa and MasterCard. As of January 27, 2013, card associations must permit merchants to add surcharges to certain credit card transactions. That means the credit card brands (Visa, MasterCard, and others) cannot forbid surcharging in their guidelines. They can still restrict surcharging to certain parameters.

Following the 2013 ruling, many states stepped in to outlaw surcharging. As of early 2021, the following states are enforcing bans on credit card surcharging on the grounds that it’s unfair to consumers:

  • Connecticut
  • Massachusetts

*If your business is considering imposing a surcharge on credit cards and you’re unsure of the legality of the practice in your state, check with a business lawyer or your state’s Attorney General.

To determine what your surcharge rate should be, first you’ll need to determine your “effective rate.”

Effective rate = Your total monthly fees divided by your total processing volume.

Knowing your effective rate will help you determine the fees or discounts you should implement. Most cash discount and surcharge programs have fixed rates around 3.5% to 4%. If your effective rate is lower than the fixed rate offered, you will overcharge your customers with a surcharge program.

Keep in mind that the surcharge fee cannot be greater than the costs you incur by accepting a given brand’s credit cards. There are also different surcharge caps you can implement. Talk to your Basys representative and we can guide you through the options and exceptions.
